Cancellation Terms

1. GENERAL CANCELLATION TERMS
1.1. These Cancellation Terms apply to all subscription services provided by M/s. Hyperleap Software Technologies Private Limited ("Company", "We", "Us", "Our") to You ("User", "Customer", "You", "Your").
1.2. These Cancellation Terms are incorporated by reference into our Terms of Use and Payment Terms. By subscribing to our Services, You agree to be bound by these Cancellation Terms.
1.3. You have the right to cancel Your subscription at any time through Your account dashboard or by contacting our support team.
2. WHEN CANCELLATIONS TAKE EFFECT
2.1. Next Billing Cycle: All subscription cancellations take effect at the end of Your current billing cycle, not immediately upon cancellation request.
2.2. Continued Access: After canceling, You will continue to have full access to all paid features and services until the end of Your current billing period.
2.3. No Immediate Termination: We do not offer immediate termination of services upon cancellation request, except in cases of:
- Account termination for violation of terms
- Fraudulent activity
- Legal requirements
- Requests from deceased account holders' legal representatives
2.4. Billing Cycle Examples:
- If You cancel on January 15th with a billing cycle from January 1-31, access continues until January 31st
- If You cancel on March 10th with an annual plan ending December 31st, access continues until December 31st
3. HOW TO CANCEL YOUR SUBSCRIPTION
3.1. Self-Service Cancellation: You can cancel Your subscription at any time through:
- Your account dashboard under "Billing & Subscription"
- The subscription management section in Your user settings
- Direct cancellation links in billing emails
3.2. Support-Assisted Cancellation: You may also cancel by contacting our support team at:
- Email: support@hyperleap.ai or accounts@hyperleap.ai
- Include Your account email and cancellation request
- We will process the cancellation within 24-48 hours
3.3. Third-Party Platform Cancellations: If You subscribed through a third-party platform (App Store, Google Play, etc.), You must cancel through that platform's subscription management system.
3.4. Enterprise Account Cancellations: Enterprise customers should contact their account manager or follow the cancellation process outlined in their separate agreement.
4. CANCELLATION CONFIRMATION
4.1. Email Confirmation: You will receive an email confirmation within 24 hours of Your cancellation request.
4.2. Confirmation Details: The confirmation email will include:
- Cancellation effective date
- Last day of service access
- Final billing date (if applicable)
- Data export instructions
- Reactivation process information
4.3. Account Dashboard Updates: Your account dashboard will also reflect the cancellation status and show the service end date.
5. MONTHLY VS. ANNUAL SUBSCRIPTION CANCELLATIONS
5.1. Monthly Subscriptions:
- Cancellation takes effect at the end of the current monthly billing cycle
- No further monthly charges will be applied
- Access continues until the end of the paid month
5.2. Annual Subscriptions:
- Cancellation takes effect at the end of the annual billing period
- No refund is provided for the remaining unused months (unless required by law)
- Access continues for the full remaining period of the annual subscription
- The subscription will not auto-renew for another year
5.3. Converting Annual to Monthly: If You wish to convert from annual to monthly billing instead of canceling:
- Annual discount will be reversed for used months
- Additional charges may apply for the difference
- Future billing will be monthly at regular rates
6. AUTOMATIC RENEWALS AND CANCELLATION
6.1. Auto-Renewal Prevention: Canceling Your subscription prevents automatic renewal at the end of Your current billing cycle.
6.2. Renewal Reminders: We send renewal reminder emails before each billing cycle. These emails include easy cancellation options.
6.3. Grace Period: If You cancel within 24 hours of an automatic renewal charge, we may provide a refund at our discretion (subject to our Refund Policy).
6.4. Preventing Accidental Renewals: You can disable auto-renewal without canceling Your current subscription, allowing You to use the service until the end of the billing period without future charges.
7. PLAN DOWNGRADES VS. CANCELLATION
7.1. Downgrade Option: Instead of canceling, You may choose to downgrade to a lower-tier plan or free plan (if available).
7.2. Downgrade Timing: Plan downgrades take effect at the end of the current billing cycle, similar to cancellations.
7.3. Feature Access: You will retain access to current plan features until the downgrade takes effect.
7.4. Data Retention: Downgrading may result in data limitations based on the new plan's restrictions.
8. DATA EXPORT AND ACCESS AFTER CANCELLATION
8.1. Data Export Period: You have until the end of Your billing cycle to export Your data.
8.2. Export Options: Available export formats include:
- CSV files for structured data
- JSON exports for technical users
- PDF reports for documentation
- API access for bulk data extraction (Enterprise plans)
8.3. Data Retention After Cancellation:
- Your data is retained for 30 days after subscription ends
- After 30 days, data may be permanently deleted
- Account reactivation within 30 days restores full data access
8.4. Data Deletion Requests: You may request immediate data deletion upon cancellation by contacting support@hyperleap.ai.
9. ACCOUNT REACTIVATION
9.1. Reactivation Window: You can reactivate Your canceled account within 30 days of the cancellation effective date.
9.2. Reactivation Process:
- Log into Your account and select a new subscription plan
- Update payment information if needed
- Your data and settings will be restored
- New billing cycle begins immediately upon reactivation
9.3. After 30 Days: If You wish to use our services after 30 days, You will need to create a new account and re-import any data You previously exported.
10. SPECIAL CANCELLATION CASES
10.1. Deceased Account Holders: Legal representatives of deceased account holders may request immediate cancellation by providing:
- Death certificate
- Legal documentation of authority
- Account information and payment method details
10.2. Incapacitated Account Holders: Legal guardians may request cancellation with appropriate legal documentation.
10.3. Corporate Account Dissolution: Dissolved entities may have immediate cancellation upon providing legal dissolution documents.
10.4. Fraud or Unauthorized Access: Accounts compromised by fraud may be immediately canceled for security purposes.
11. FAILED PAYMENTS AND AUTOMATIC CANCELLATION
11.1. Payment Failure Process: If payments fail, Your account may be automatically downgraded or suspended rather than canceled.
11.2. Automatic Cancellation: Accounts may be automatically canceled if:
- Payment fails for more than 30 days
- Multiple failed payment attempts
- Chargeback or payment disputes
- Expired payment methods that cannot be updated
11.3. Notification: You will receive multiple notifications before automatic cancellation due to payment issues.
12. COMPANY-INITIATED CANCELLATION
12.1. Terms Violation: We may immediately cancel accounts that violate our Terms of Use.
12.2. Service Discontinuation: If we discontinue a service, we will provide:
- 60 days' advance notice where possible
- Data export assistance
- Migration options to alternative services
- Pro-rated refunds where legally required
12.3. Business Changes: Significant business model changes will be communicated with adequate notice and cancellation options.
13. LEGAL RIGHTS AND CONSUMER PROTECTION
13.1. Consumer Rights: Nothing in these terms affects Your statutory rights under consumer protection laws in Your jurisdiction.
13.2. Cooling-Off Periods: Where applicable by law, You may have cooling-off period rights that allow for immediate cancellation and refunds.
13.3. Regulatory Compliance: Our cancellation terms comply with applicable regulations including:
- EU Consumer Rights Directive
- FTC regulations (United States)
- Consumer Protection Act (India)
- Competition and Consumer Act (Australia)
- Local consumer protection laws
14. CHANGES TO CANCELLATION TERMS
14.1. We may modify these Cancellation Terms with 30 days' prior written notice.
14.2. Changes will not affect existing subscriptions' cancellation rights until their next renewal period.
14.3. If You disagree with the changes, You may cancel Your subscription under the current terms before the changes take effect.
