Refund Policy

1. GENERAL REFUND POLICY

1.1. This Refund Policy applies to all subscription services provided by M/s. Hyperleap Software Technologies Private Limited ("Company", "We", "Us", "Our") to You ("User", "Customer", "You", "Your").

1.2. This Refund Policy is incorporated by reference into our Terms of Use and Payment Terms. By subscribing to our Services, You agree to be bound by this Refund Policy.

1.3. Generally, we do not provide refunds for subscription services except as explicitly outlined in this policy or as required by applicable law.

2. NO REFUND POLICY

2.1. Standard Policy: All subscription fees are non-refundable once paid, except as specifically provided in this policy.

2.2. This no-refund policy applies to:

  • Monthly subscription fees
  • Annual subscription fees
  • One-time setup fees
  • Additional feature purchases
  • Usage-based charges
  • Plan upgrade charges

2.3. Service Until End of Billing Period: When You cancel Your subscription, You will continue to have access to paid features until the end of Your current billing period. No partial refund will be provided for the unused portion of the billing period.

3. EXCEPTIONS TO NO-REFUND POLICY

3.1. Legal Requirements: We will provide pro-rated refunds where required by applicable consumer protection laws, including but not limited to:

  • European Union consumer rights directives
  • Australian Consumer Law
  • Canadian Consumer Protection Acts
  • US state consumer protection laws where applicable
  • Indian Consumer Protection Act provisions

3.2. Service Failure: We may provide refunds at our sole discretion if:

  • Our service is unavailable for more than 48 consecutive hours due to our technical issues
  • We are unable to deliver the core functionality as described
  • There is a material breach of our service commitments

3.3. Billing Errors: If we make an error in billing, we will correct the error and refund any overcharge.

3.4. Fraudulent Charges: If charges are made without Your authorization, we will investigate and provide appropriate refunds upon verification.

4. PRO-RATED REFUNDS

4.1. When Pro-Rated Refunds Apply: Pro-rated refunds will only be provided where legally required by consumer protection laws in Your jurisdiction.

4.2. Calculation Method: Pro-rated refunds are calculated as follows:

  • Total amount paid ÷ Total days in billing period × Remaining days in billing period
  • Minimum refund amount: $5 USD or equivalent local currency
  • Refunds less than the minimum amount will not be processed

4.3. Processing Time: Pro-rated refunds will be processed within 10-15 business days after the refund is approved.

4.4. Refund Method: Refunds will be issued to the original payment method used for the subscription.

5. ANNUAL PLAN REFUNDS

5.1. Standard Policy: Annual subscription fees are non-refundable except where required by law.

5.2. Conversion to Monthly: If You wish to convert from an annual plan to a monthly plan mid-cycle:

  • The annual discount will be reversed for all months already used
  • You will be charged the difference between annual discounted rate and monthly rate for used months
  • No refund will be provided; additional charges may apply
  • Future billing will continue on a monthly basis

5.3. Legal Refund Rights: Where consumer protection laws provide refund rights for annual subscriptions, we will comply with such legal requirements.

6. PLAN DOWNGRADES

6.1. No Refunds for Downgrades: When You downgrade Your subscription plan, no refund will be provided for the current billing period.

6.2. Service Continuation: You will continue to have access to Your current plan features until the end of the billing period.

6.3. Effective Date: The downgraded plan and pricing will take effect on Your next billing cycle.

7. FREE TRIAL AND PROMOTIONAL OFFERS

7.1. Free Trials: No refunds are applicable for free trial periods as no payment is collected.

7.2. Promotional Pricing: Subscriptions obtained through promotional offers or discounts are subject to the same refund policy as regular subscriptions.

7.3. Trial-to-Paid Conversion: If You are charged after a free trial period, standard refund policies apply from the first paid billing cycle.

8. THIRD-PARTY PURCHASES

8.1. App Store Purchases: For subscriptions purchased through third-party platforms (Apple App Store, Google Play Store, etc.), refund requests must be made directly to the platform provider.

8.2. Merchant of Record: When using a merchant of record (Paddle, DodoPayments, etc.), their refund policies may also apply alongside ours.

8.3. Platform Refund Policies: We cannot override refund decisions made by third-party platforms or payment processors.

9. REFUND REQUEST PROCESS

9.1. How to Request: Refund requests must be submitted in writing to billing@hyperleap.ai with the following information:

  • Account email address
  • Subscription details (plan type, billing cycle)
  • Reason for refund request
  • Documentation supporting legal refund rights (if applicable)

9.2. Review Process: We will review all refund requests and respond within 5-7 business days.

9.3. Decision Factors: Refund decisions will be based on:

  • Applicable legal requirements
  • Terms of this refund policy
  • Specific circumstances of the request
  • Service usage and history

9.4. Final Decision: All refund decisions are final and at our sole discretion, except where overridden by applicable law.

10. REFUND PROCESSING

10.1. Processing Time: Approved refunds will be processed within 10-15 business days of approval.

10.2. Refund Method: Refunds will be issued using the original payment method when possible:

  • Credit card refunds: 3-10 business days
  • Bank transfer refunds: 5-15 business days
  • Digital wallet refunds: 1-5 business days

10.3. Processing Fees: Refund processing fees charged by payment processors or banks will be deducted from the refund amount.

10.4. Currency Conversion: Refunds will be processed in the same currency as the original payment. Currency conversion fees (if any) are Your responsibility.

11. ACCOUNT TERMINATION AND REFUNDS

11.1. Voluntary Termination: If You voluntarily terminate Your account, no refund will be provided for the current billing period.

11.2. Termination for Cause: If we terminate Your account for violation of terms, no refund will be provided.

11.3. Service Discontinuation: If we discontinue a service, we will provide reasonable notice and may offer:

  • Pro-rated refunds for unused service periods
  • Migration to alternative services
  • Extended access during transition period

12. DISPUTE RESOLUTION

12.1. Internal Resolution: We encourage customers to first attempt to resolve refund disputes through our customer support team.

12.2. Chargeback Policy: Initiating a chargeback without first contacting us may result in immediate account termination.

12.3. Legal Action: Any disputes regarding refunds will be resolved according to the dispute resolution terms in our Terms of Use.

13. CHANGES TO REFUND POLICY

13.1. We may modify this Refund Policy with 30 days' prior written notice.

13.2. Changes will not affect refund rights for charges made before the effective date of the changes.

13.3. Continued use of our services after policy changes constitutes acceptance of the modified refund policy.
